La grave crisis financiera de la Comisión Interamericana de Derechos Humanos compromete seriamente el futuro del Sistema Interamericano de Derechos Humanos y la promoción y protección de derechos humanos en la región.

El futuro del Sistema Interamericano de Derechos Humanos está en juego y se necesita acción urgente. El 23 de mayo, la Comisión Interamericana de Derechos Humanos anunció que enfrente una grave y aguda crisis financiera. La noticia de que la Comisión perderá el 40% de su personal el 31 de julio de 2016, a menos que se tome acción urgente, es preocupante no solamente por las consecuencias que esta medida tendrá en cada una de las 30 personas afectadas (y sus familias). El impacto de estos recortes forzados en la protección y promoción de derechos humanos en los 35 Estados Miembros de la OEA será devastador.

La crisis financiera que enfrenta la Comisión amenaza con efectivamente desmantelar la institución de derechos humanos más importante de las Américas. La Comisión se creó en 1959 por los Estados Miembros de la OEA con el mandato de garantizar la promoción y protección de derechos humanos en el hemisferio. Desde entonces, la Comisión ha viajado a través de la región documentando violaciones de derechos humanos a través de visitas in loco, ha publicado múltiples informes temáticos y de país sobre una amplia gama de derechos, ha otorgado medidas de protección a personas en riesgo inminente y ha prestado asistencia técnica a los gobiernos. De particular importancia es que la Comisión se ha convertido en un mecanismo clave de justicia internacional para personas del hemisferio a quienes se les ha negado la justicia en sus países.

La Comisión también ha sido promotora activa de respuestas innovadoras a crisis de derechos humanos. Más recientemente, el Grupo Interdisciplinario de Expertos Independientes designado para investigar la desaparición de 43 estudiantes en Ayotzinapa, México, ofrece un ejemplo notable de la capacidad de la Comisión de responder oportunamente a graves violaciones de derechos humanos. Sin duda, la Comisión ha contribuido significativamente a la protección y promoción de derechos humanos en las Américas y ha servido de ejemplo para instituciones de derechos humanos en todo el mundo.

Es por estas razones que las personas firmantes, integrantes de la academia, profesionales y grupos de derechos humanos, deploramos la actual crisis financiera que enfrenta la Comisión y urgen, en primer lugar, a los Estados Miembros de la OEA a garantizar que los fondos necesarios serán puestos a disposición de la Comisión, a más tardar, el 15 de junio de 2016. También hacemos un llamado a donantes internacionales para apoyar en estos momentos de profunda crisis.

Después de más de medio siglo de trabajo, la Comisión continúa luchando para adelantar sus múltiples funciones pues los Estados, históricamente, no le han proporcionado los recursos financieros necesarios. Esto significa que la crisis actual exacerba un problema recurrente. La causa inmediata de esta falta de financiamiento adecuado no es la ausencia de recursos económicos. Más bien, la crisis financiera se origina en la ausencia de la voluntad política necesaria para apoyar el trabajo de la Comisión. Prueba de ello es que, de acuerdo al editorial de James Cavallaro, Presidente de la Comisión Interamericana, publicado en el periódico El País, los países de América Latina y el Caribe aportaron 13.7 millones de dólares estadounidenses a la Corte Penal Internacional, que no se encuentra ejerciendo su jurisdicción sobre ninguna situación que involucre a un Estado Miembro de la OEA (únicamente hay una situación bajo examen preliminar). No obstante, únicamente destinaron 199,000 dólares estadounidenses a la Comisión Interamericana.

La Comisión ya se enfrenta a una grave acumulación de casos pendientes que dificulta el derecho de las víctimas a la justicia internacional. La Comisión simplemente no tiene la capacidad de procesar las peticiones que las personas de toda la región presentan, y más y más personas están recurriendo al Sistema para obtener justicia sobre lo que consideran son violaciones de derechos humanos que los Estados no han podido o no han querido atender. En efecto, de acuerdo al Informe Anual 2015 de la Comisión, al concluir ese año, un total de 9673 peticiones se encontraban pendientes de evaluación inicial y 1903 se encontraban en las etapas de admisibilidad y/o fondo. La Comisión está intentando atender esta acumulación con el personal limitado con el que cuenta. Perder el 40% de su personal simplemente implica que la capacidad de la Comisión de procesar peticiones disminuirá aún más, con consecuencias devastadoras para las víctimas para quienes, en muchas ocasiones, el Sistema es la única esperanza de obtener justicia.

Del mismo modo, la capacidad de la Comisión de dictar medidas cautelares probablemente colapsaría, pues los recortes anunciados por la Comisión afectarían al 80% del ya reducido equipo responsable de su tramitación. Más aún, la promoción de derechos humanos en las Américas también se vería afectada, en un momento de mucha necesidad, dadas las condiciones políticas y económicas de la región y la forma en que afectan los derechos humanos. En lo inmediato, la Comisión ha anunciado que cancelará todas las visitas a Estados que tenía planeadas para este año y que no llevará a cabo sus periodos de sesiones de junio y octubre.

Debe ser claro para todos los actores interesados, incluyendo Estados Miembros de la OEA, la comunidad internacional y potenciales donantes, que el desafío más apremiante no solamente es evitar la pérdida de 30 personas (de un total de 78) empleadas por la Comisión. También resulta vital que la Comisión reciba los recursos necesarios para proteger y promover los derechos humanos en la región durante los próximos años. Dicho trabajo implica mucho más que atender la presente crisis financiera. Si los derechos humanos son importantes para los Estados, tal y como los Estados Miembros de la OEA declaran solemnemente al ratificar tratados internacionales, en sus Constituciones Nacionales y en su legislación, deben demostrar esto políticamente y financieramente. Como lo demuestra la actual crisis, el financiamiento de una institución regional de derechos humanos como la Comisión Interamericana no puede seguir dependiendo de fuentes externas de financiamiento. El financiamiento debe provenir de los Estados Miembros de la OEA.

En virtud de que la situación es de gran preocupación, es crucial apoyar el llamado público de la CIDH a los Estados de atender esta situación, proveyéndole de:

1. donaciones urgentes que permitan, al menos, mantener el número actual de personal y adelantar las actividades planeadas a la fecha; y,
2. un adecuado financiamiento del fondo regular de la OEA destinado a la Comisión, así como a la Corte Interamericana de Derechos Humanos, a un nivel que corresponda con la carga de trabajo y la importancia institucional del trabajo de estos órganos.

Además, hacemos un llamado a los Estados Miembros de la OEA para adoptar las medidas que sean necesarias para garantizar que una crisis de esta naturaleza no se repita en el futuro.

Debe también recordarse que, en marzo de este año, el Presidente de la Corte Interamericana, expresó ante el Consejo Permanente de la OEA que la Corte opera con el menor presupuesto de cualquier tribunal internacional. La situación financiera de la Corte es grave y se deteriora, ya que perdió 25% de su presupuesto luego del retiro de financiamiento por parte de donantes internacionales. De modo que estos problemas financieros no afectan solamente a la Comisión, sino también a la Corte.

Las personas y organizaciones firmantes urgen a todas las partes interesadas a atender inmediatamente el financiamiento del Sistema Interamericano de Derechos Humanos, con el fin de garantizar su viabilidad. Es crucial que todos los Estados de la región contribuyan a la promoción y protección de los derechos humanos en el hemisferio, particularmente, cuando lo que está en juego es el futuro del Sistema Interamericano y la protección de millones de personas en la región.
